This policy should be read together with the Privacy Policy and the Software Licence.

1. Acceptance of Terms

By accessing or using SELENO ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

The operator of this Service reserves the right to modify or update these terms at any time. Continued use of the Service after changes are made constitutes acceptance of the revised terms.

2. Description of the Service

The Service provides users with the ability to remotely control a telescope via a web-based interface. Features of the Service may include:

  • Selecting astronomical objects
  • Controlling telescope movement
  • Capturing and downloading images
  • Viewing observational data

This system is an educational project and may be experimental in nature. The Service is provided for personal and educational use only.

3. User Accounts

To access certain features of the Service, users may be required to create an account.

Users are responsible for:

  • Maintaining the confidentiality of their login details
  • All activity carried out under their account
  • Ensuring that information provided is accurate

The operator reserves the right to suspend or terminate accounts that violate these Terms of Service.

4. Acceptable Use Policy

Users agree to use the Service responsibly and in accordance with the following rules.

Users must NOT:

  • Attempt to damage, interfere with, or disrupt the telescope hardware or software
  • Attempt to gain unauthorised access to any part of the system
  • Use automated tools to overload or spam the system
  • Exploit bugs or security vulnerabilities
  • Use the Service for any illegal, harmful, or unethical purpose

Any misuse of the Service may result in immediate suspension or permanent banning of the user account.

5. Service Availability

The operator makes no guarantee that the Service will be available at all times.

The Service may be unavailable due to factors including but not limited to:

  • Poor weather conditions
  • Hardware or software failures
  • Internet or power outages
  • Maintenance or upgrades

To the extent permitted by law, the operator is not responsible for any inconvenience caused by system downtime. This does not affect the statutory rights described in Section 6.

6. Limitation of Liability

The Service is provided "as is" without any warranties or guarantees.

To the extent permitted by law, the operator is not responsible for:

  • Loss of data
  • Missed observations
  • System errors or inaccuracies
  • Hardware malfunctions
  • Any damages arising from the use or inability to use the Service

Users access and use the system entirely at their own risk.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, where such exclusion or limitation is not permitted under the laws of England and Wales. Nothing in these Terms removes any statutory right you have as a consumer, including under the Consumer Rights Act 2015, in respect of any paid booking made through the Service; those rights exist alongside, not instead of, this Section.

7. Data Collection and Privacy

In order to operate the Service, certain user data may be collected, including:

  • Account information (e.g., username and email address)
  • System logs and usage data
  • Images captured using the telescope

Passwords are stored securely using industry-standard hashing techniques.

User data will not be sold or shared with third parties. Data is used solely for the operation and improvement of the Service. See the Privacy Policy for full details.

8. Intellectual Property

All software, code, and design elements of the Service remain the intellectual property of the operator, subject to the Third Party Components identified in the Software Licence.

Users retain ownership of any images or data they personally capture using the system. However, the operator reserves the right to display anonymised images for demonstration or educational purposes.

9. Termination

The operator reserves the right to:

  • Suspend or delete user accounts
  • Restrict access to the Service
  • Shut down the Service permanently

This may occur at any time and for any reason, including violation of these Terms of Service.

10. Safety and Responsibility

This Service controls real physical hardware. Users acknowledge that:

  • They have no physical access to the telescope
  • All actions are performed remotely
  • The operator is not responsible for any damage caused by attempts to replicate or modify the system

To the extent permitted by law, the operator is not liable for any death, personal injury, or property damage arising from use of the Service, except where caused by the operator's own negligence, in which case liability is not excluded.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
